Gail Harker Center for Creative Arts Online Auctions Terms and Conditions
These terms and conditions apply to all online bidding at auction sales conducted in conjunction with the Gail Harker Center for Creative Arts Online Benefit Auction (GHC-OBA).
These Online Bidding Terms and Conditions are supplemental, meaning that they shall apply in addition to the general Conditions of Sale and other terms and conditions applicable to bidders and buyers participating in the subject Sale (collectively, the “Bid Conditions”) and shall be deemed incorporated by reference and made a part of the Bid Conditions for such Sale. The general Bid Conditions are published on our web site, among other places. Additional information applicable to the Sale may also be set out on our web site, and it is your responsibility to review that information. In registering to bid at any Sale, you agree to applicable Bid Conditions.
Eligibility
Our services are available only to individuals who can enter into legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. If you are a minor, you may use our services only in conjunction with your parent or legal guardian. If you do not qualify, please do not use our services. Further, your account and user ID may not be transferred or sold to another party. You may be required in some cases to provide credit card information. The GHC-OBA is only shipping to the US and Canada.
Registration
- Before you can bid, you must register to bid online. The registration page can be accessed by Clicking Here.
- Once you have registered, you should keep your account details strictly confidential and you must not permit any third party to use or access your account on your behalf or otherwise. You will be liable for any and all bids made via your account.
Online Bidding Process
- Once you have successful registered for Online Bidding in the GHC-OBA, you will be eligible to bid online in the Sale.
- While the auction is live, you can bid by clicking on the Bid button. Each bid will be final and binding as soon as you click the Bid button.
- The current bid will be displayed on your screen during the Sale.
- Minimum Bids- The minimum bid for all auction items is $40.
- Bidding your max amount- You may place a max bid on Listed Item(s). A max bid is the maximum you’d like to pay for the item. When you place a max bid, our bidding technology will automatically place bids on your behalf, using the smallest increment necessary to ensure you remain the high bidder until your max bid is met. If another bidder has placed the same bid before you, or a max bid that is higher than yours, the auction software is designed to contact bidders to let you know that you have been outbid. In that situation, you may attempt to place another bid within the specific auction time. For instance, if there are no bids on an item, you can place a bid for $120- the system will show that there is a bid for $40. If someone then bids $60, the system will do the minimum raise of $5, and you will remain the winner at $65.
- Our auctions will end at 6 pm Pacific time on Sunday, November 17. However, the bidding period on any listed item will be extended 5 minutes when a higher bid than the then-current top bid is placed prior to expiration of that auction. The bidding period will continue as long as such higher bids are being placed within 5 minutes of the last higher bid.
- GHC reserves the right to withdraw, postpone, or cancel any Listed item(s), in our sole discretion, with or without notice. We shall have no liability to you as a result of any withdrawal, postponement or cancellation.
- GHC reserves the right to void a bid that you place, whether winning or not, which we believe (i) has not been made in good faith and in accordance with these Terms; or (ii) is intended to manipulate our Services.
- The Seller is conducting the auction and makes the sold and final determination with respect to the sale of Listed Item(s).
- We do not guarantee that bids placed will be received and processed in a timely manner. Our online software system has been tested and we anticipate that all will work well.
Prohibited Bidder Conduct: Any deliberate attempt to artificially influence the sale price of any Listed Item(s), directly or indirectly, including by not limited to bidding through a secondary account, agent, or representative, bidding on Listed items(s) that you may also be selling, communicating with other Bidders, or shill bidding (trying to artificially inflate the price) is expressly prohibited.
Winning Bids: Upon close of each auction, the winning bidder will receive an email notification that they have won and how to complete the payment.
Shipping Costs: The purchaser will be responsible for the cost of Shipping (only open to US or Canada). Buyers are also able to arrange to pick up their purchased items at the Gail Harker Center, rather than paying for shipping.
Additional Bidder Indemnity. In addition to the indemnification provisions set forth in the Terms of Use For GHC-OBA, you agree to indemnify, defend, and hold harmless the Indemnified Parties from and against any and all damages, costs, claims or liability (including reasonable attorneys’ fees) arising out of or resulting from any injuries to persons or property of any type, occurring during your or your agent’s inspection of property, or your or your agent’s presence at a Seller’s site, or resulting from the sale, removal, use or operations of any Listed Item(s).
Conflicts. In the event of a conflict between the provisions set forth in these Bidder Terms and the Terms of Use For GHC-OBA, the Terms of Use For GHC-OBA shall prevail.
